Firefighter Employment Scenario Essay
Based on the fact that Doug and Sam earned the first and second highest test scores, is it a reasonable assumption that the city of Davis will add Doug and Sam to the certification list? Yes Why or why not? With the top scores on the exam, they should be first in line for certification and an opportunity to interview for the position in question. Can the City successfully defend itself on the basis of ââ¬Å"disparate impact?â⬠No Why or why not? Doug and Sam had the top scores on the certification exam. This does not automatically make them promotable, they would still have to go through the interview process just like any other candidate. The city could have easily certified additional members of minority groups in addition to Doug and Sam. Since they were the top performers they should be on the list, this could be a case of reverse discrimination. Under what circumstances may racial discrimination be proved by ââ¬Å"disparate impact?â⬠Disparate impact according to the book occurs when an employer discriminates against an entire protected class (Cheeseman, 2013). It would be difficult to prove disparate impact, because the city has the ability to accept multiple applicants and certify more than just two slots.

Human genetic disorders can arise as a consequence of mutations in Essay
Human genetic disorders can arise as a consequence of mutations in either nuclear or mitochondrial genomes. Using specific examp - Essay Example These are called so because they carry genes for the determination of the sex of the newborn and they are also of two types i.e. X & Y chromosomes where X is for female and Y for Male. The chromosomes are mainly classified either on the basis of their banding or on the basis of the position of the centromere i.e. the central point of every chromosome. The basic constitutive component of these DNA molecules, euchromatin and heterochromatin is the main factor on which the DNA on all these chromosomes differ from each other. Still, on some of the chromosomes e.g. 1, 9 and 16 show heterochromatin in their centromere region where as Chromosome Y is also considered to contain more heterochromatin. (T. STRACHAN and A. READ, 2004,p19) Mitochondrial genes There usually are two strands in mitochondrial genome i.e. H and L strand. The H strand is supposed to encode more genes i.e. 28 out of 37 where as the L strand encodes the remaining number of genes. The mitochondrial genome is not very much similar to the nuclear genome as it does not contain any introns as well as it is very much compact and tightly packed as compared to the loosely packed nuclear genome. Most of the coding sequences are separated by one or two of the non coding bases while overlapping is observed in only some of the coding sequences. In some genes post transcription introduction of of UAA codon i.e. termination codon is necessary since they lack their own termination codons. (T. STRACHAN and A. READ, 2004,p19) Figure 9.3 The organization of the human mitochondrial genome. The H strand is transcribed from two closely spaced promoter regions fl anking the tRNAPhe gene (grouped here as PH); the L strand is transcribed from the PL promoter in the opposite direction. In both cases, large primary transcripts are produced and cleaved to generate RNAs for individual genes. All genes lack introns and are closely clustered. The symbols for protein-coding genes are shown here without the prefi x MT- that signi fi es mitochondrial gene. The genes that encode subunits 6 and 8 of the ATP synthase (ATP6 and ATP8) are partly overlapping. Other polypeptide-encoding genes specify seven NADH dehydrogenase subunits (ND4L and ND1ââ¬âND6), three cytochrome c oxidase subunits (CO1ââ¬âCO3), and cytochrome b (CYB). tRNA genes are represented with the name of the amino acid that they bind. The short 7S DNA strand is produced by repeat synthesis of a short segment of the H strand (see Figure 9.2). COMPARISON OF NUCLEAR AND MITOCHONDRIAL GENOME (T. STRACHAN and A. READ, 2004,p21) Single gene disorders These mainly include autosomal, X linked and Y linked. These disorders are called as Mendelian disorders as they follow the mendelian order of inheritance. Some other disorders such as Non mendelians ones are also included in the list. (AKUL MEHTA.2012) Both the sperm and the egg contribute to the formation nuclear genome in the zygote whereas the mitochondrial is supposed to take the sequence from t he egg only.(T. STRACHAN and A. READ, 2004) Autosomal dominant These disorders are usually common in the offsprings who have one of the two parents with the abnormality. These disorders are mainly caused by mutation in one of the genes only with the 50 % possibility of getting the mutated gene. The disease usually develops later in the life or it would even not appear at all as the penetrance

Fed Watch QE End and First Rate Hike Essay Example | Topics and Well Written Essays - 500 words
Fed Watch QE End and First Rate Hike - Essay Example The central bank in effect increases the monetary base. The need for changes in monetary policy arises from a failing policy or one that is not effective in creating the economic impact required. According to the information gathered and the specific economic signs available, chances are high that several hikes will materialize in the year 2015. Considering various studies conducted on the same, 38 respondents that included analysts, money managers, and economists, there looms a possibility of a hike in the rate in 2015. According to the information gathered, the hike will result in steeper interest rate increases in the coming years. The survey indicates that the rates will hike to a high of 3.04% by the end of 2017 (Liesman). When this takes effect, the Feds take a longer time normalizing the rates based on the need for constant review the rates in consideration of the effect they create. The application of an expansionary monetary policy reaches a point of failure when the interest rates on the short-term run towards zero. These explain situations that quantitative easing becomes applicable. Quantitative easing applied during these periods of low-interest rates aids in improving the inflation rate and reducing its effect. Quantitative easing aids in stabilizing inflation and controlling the rate to maintain it within the targeted points of the economy. These are accompanied by the improvement of the economic policies to make the economic policy more effective in helping the central bank take action against deflation. The increased money supply in an economy with less interest affects the money supply. The banks will run low on money to lend and have their reserves risk lowering further due to a high money supply in the market and uncontrolled demand. To reduce these effects, the central bank hikes the rates and mops out the excess liquidity from the market to aid in improving the economic situation. In addition, a high-interest rate reflects a decreased

Law - Civil Procedure (Hong Kong) Essay Example | Topics and Well Written Essays - 1500 words
Law - Civil Procedure (Hong Kong) - Essay Example James (1854) 5 De G.M. & G. 876 and its brethren (Novello v. James (1854) 5 De G.M. & G. 876). This undertaking is not given to the party against whom the injunction is sought, but to the court who is overseeing the proceedings from which the injunction came (Zuckerman, 1994, p. 546). The reason that the plaintiff has to give this undertaking is in the event that either the injunction is dismissed for any reason, or that the defendant wins in a trial on the merits. In either of those cases, it must be shown that the defendant was kept from exercising his or her lawful rights, and was harmed by this. Therefore, the money given as an undertaking must be equivalent to what monetary damage that the defendant would experience because of this loss of rights. This undertaking is a safeguard for defendantââ¬â¢s rights, as the court is sworn to give both parties equal treatment, and it is a matter of ââ¬Å"elementary fairnessâ⬠that this undertaking is given (Kirklees Borough Council v. Wickes Building Supplies Ltd. [1991] 3 W.L.R. 985). However, the entitlement to damages is not independent of the undertaking (Fletcher Sutcliffe Wild Ltd. v. Burch [1982] F.S.R. 64), and whether or not the defendant is entitled to the undertaking is not decided by the material event, such as the injunction being dismissed or the defendant prevailing on the merits, but, rather, is a discretion of the court (Attorney General v. Albany Hotel Co. [1986] 2 Ch. 696). This discretion is not limited in any way (Cheltenham and Gloucester Building Society v. Ricketts [1993] 1 W.L.R. 1545. This means that the court does not necessarily have to grant the defendant the damages that have been deposited, even if the defendant prevails on the merits and even if the injunction is dismissed, and this discretion about whether or not to award the defendant is essentially unbridled. This brings up the question of what the undertaking is meant to compensate. The injunction usurps the defendantââ¬â ¢s rights in some way, and this is a harm that is suffered by the defendant. For instance, perhaps the defendant is enjoined from keeping open his business after he has already opened it, because the plaintiff seeks an injunction based upon the fact that defendant is, say, operating a business that is not zoned for a particular area. As it turns out, the zoning for the area is proper, and the existence of the business in this area is also proper. Yet Defendant has now lost several days or even weeks of business. This is a clear harm to the defendant, yet the court does not have to award the defendant the undertaking if the court deems this to be fit, and this discretion is not limited, therefore the defendant probably could not prevail on an appeal on the matter, as appeals courts are loathe to interfere with judicial discretion. This is obviously an injustice, but, since an undertaking is not a function of tort, criminal or contract law, it is difficult to classify it, so it is di fficult to state what is proper when examining judicial discretion on the issue. One clear way that the defendant may get the undertaking would be when it is clear that the injunction should never have been granted (Norwest Holst Civil Engineering Ltd. v. Polysius [1987] CA Transcript 644. However, there is a difficulty in ascertaining when an injunction should
